Punishments for possession of cocaine with intent to distribute in Georgia
When you find yourself charged with possession of cocaine with intent to distribute, you are facing a sentence of five to thirty years for a first offense and ten to forty years (or life in prison) for a second offense. Getting "straight probation" is much more difficult than a possession charge, especially for a second or subsequent offense.
No minimum amount for possession with intent to distribute
There is no minimum amount of cocaine that a person must possess in order to be charged with possession with intent to distribute (PWID). If the police believe the amount was more than a "normal user" would have, it was divided into a number of small plastic bags (like jeweler's bags), or digital scales are found nearby, a charge of possession with intent to distribute may follow.
If the State can prove that a person was both cooking crack cocaine and in possession of some of the drug, he or she will probably be charged with both manufacturing cocaine and possession with intent to distribute.
